Finarta Art Club: Terms and Conditions

1. Who we are

The Finarta Art Club (the “Club”) is operated by Arkany SA (Finarta), a company registered in Luxembourg under number B198105, with its registered office at 13, av de la Liberté, 1931 Luxembourg (“Finarta”, “we”, “us”). Contact: contact@finarta.com.

2. What the Club is

The Club gives private collectors access to the Finarta network: the private platform finarta.com, which brings together more than 450 galleries and art professionals in over 30 countries (the “Network”).

3. Entry fee

Membership requires a one-time entry fee of EUR 1,000 excluding VAT, payable online through this website.

4. What membership gives you

Within 24 hours of confirmed payment, Finarta will send you your personal access codes to finarta.com. From then on, you have the same rights as the existing members of the Network, namely:

  • to post requests for artworks you wish to acquire;
  • to offer artworks you wish to sell.

The entry fee gives access to the Network and these rights, and nothing more.

5. Full terms of use of finarta.com

Access to finarta.com is governed by its full terms of use, which are communicated to you when your access is opened [and are available on request before payment]. By using your access codes, you accept them.

6. Transactions

Finarta acts as an intermediary between members. We do not take ownership of the artworks. Commissions on transactions concluded through the Network are set out in the full terms of use. The Club does not guarantee that a requested artwork will be found or sold, nor any price or timeframe.

7. Personal and confidential access

Your access codes are personal and may not be shared or transferred. The content of the Network is confidential and may not be copied or disclosed to third parties. We may suspend or end an access in case of misuse.

8. Acceptance of membership

Finarta may refuse or end a membership, in particular following identity or compliance checks (including anti-money-laundering rules). If your membership is refused before your access is opened, the entry fee will be refunded in full.

9. Withdrawal and refunds

If you are a consumer, you may have a legal right to withdraw from this purchase within 14 days. By requesting immediate access, you ask us to start the service during that period. Once your access has been opened, the entry fee is non-refundable, to the extent permitted by law. If you withdraw before your access is opened, you will be refunded in full.

10. Liability

To the extent permitted by law, Finarta is not liable for indirect losses, and its total liability is limited to the entry fee paid. Nothing in these terms excludes liability that cannot be excluded by law.

11. Personal data

Your personal data is processed in accordance with our Privacy Policy [link] and applicable data protection law.

12. Governing law

These terms are governed by Luxembourg law, and the courts of Luxembourg have jurisdiction, without prejudice to any mandatory consumer rights in your country of residence.

13. Changes

We may update these terms. The version in force at the time of your payment applies to your membership.
